This Digital Services Act (DSA) Disclosure is provided by Last Call Foods ("we," "our," or "us") in compliance with the European Union's Digital Services Act. The DSA aims to create a safer digital space where the fundamental rights of users are protected and to establish a level playing field for businesses.

Platform Classification

Last Call Foods operates as an online platform that connects businesses with surplus food items to consumers who wish to purchase these items at a reduced price. Under the DSA, we are classified as an online platform, as we store and disseminate information provided by our users (both businesses and consumers) to the public.

Content Moderation

We are committed to maintaining a safe and trustworthy platform. Our content moderation practices include:

  • Automated and manual review of business listings and product descriptions
  • Monitoring user reviews and ratings for authenticity
  • Procedures for handling reports of illegal content or products
  • Measures to prevent misuse of our platform for fraudulent activities

Users can report potentially illegal content or products through our reporting mechanisms available on each listing page or by contacting our support team.

Notice and Action Mechanism

In accordance with the DSA, we have implemented a notice and action mechanism that allows any individual or entity to notify us of the presence of illegal content on our platform. Upon receiving a sufficiently precise and adequately substantiated notice, we will:

  1. Promptly acknowledge receipt of the notice
  2. Process the notice without undue delay
  3. Inform the notice provider of our decision and actions taken
  4. Provide information on redress possibilities if the notice provider disagrees with our decision

Transparency Reporting

In compliance with the DSA, we publish transparency reports that include information on:

  • Measures taken against misuse of the platform

Internal Complaint-Handling System

We have implemented an internal complaint-handling system that allows users to submit complaints about:

  • Decisions to remove or disable access to information
  • Decisions to suspend or terminate the provision of the service
  • Decisions to suspend or terminate the user's account

Complaints are handled in a timely, non-discriminatory, and transparent manner. Users can submit complaints through their account settings or by contacting our support team.

Out-of-Court Dispute Settlement

In addition to our internal complaint-handling system, users have the right to select any out-of-court dispute settlement body certified in accordance with the DSA to resolve disputes related to our decisions regarding illegal content, suspension or termination of accounts, or suspension or termination of service provision.

We will engage in good faith with the selected dispute settlement body and will be bound by the decision taken by that body.

Trusted Flaggers

We cooperate with entities that have been awarded trusted flagger status under the DSA. Notices submitted by trusted flaggers are processed and decided upon with priority and without delay.

Risk Assessment and Mitigation

We regularly assess and mitigate any systemic risks stemming from the functioning and use of our platform, including:

  • Dissemination of illegal content
  • Negative effects on the exercise of fundamental rights
  • Intentional manipulation of the service
  • Public health and food safety risks

Our risk mitigation measures include robust verification processes for businesses, quality control for food items, and clear guidelines for all platform users.

Data Access for Researchers

In accordance with the DSA, we provide access to publicly accessible data to vetted researchers for the purpose of conducting research that contributes to the detection, identification, and understanding of systemic risks.
